1) Who we are
This website (the Site) is owned and operated by Sinara Pool Villas (the Company). By accessing or using the Site, you agree to these Terms of Use (the Terms).
If you do not agree, please do not use the Site.
You must be at least 18 years old to use the Site.
2) Use of the Site
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for your personal, non-commercial purposes. You must not:

4) Confidentiality (Important)
4.1 Confidential Materials. Certain Materials (for example, pricing sheets, specifications, drawings, construction updates, agent toolkits, and sales proposals) may be marked or reasonably understood as confidential (Confidential Information). You agree to use any Confidential Information solely for evaluating a potential purchase or collaboration with Sinara Pool Villas and not to disclose it to any third party without our written consent, except to your professional advisors who are bound by confidentiality.
4.2 Agent/Partner Access. If you are an agent or partner accessing a private link or folder, you must keep access credentials secure, share only with authorised team members, and promptly delete/return Confidential Information on our request.
4.3 Public vs. Private. Publicly available content on the Site is not Confidential Information; however, any compilations, internal pricing, unpublished designs, limited-release visuals, or non-public availability data are confidential.
4.4 Remedies. Unauthorised use or disclosure may cause irreparable harm. We may seek injunctive relief and any other remedies available under Thai law.
5) User Content
If you submit any content (enquiries, forms, comments, files) (User Content), you are responsible for it. You confirm that it is lawful and does not infringe any rights. You grant us a worldwide, royalty-free licence to use, host, reproduce, and display your User Content to operate and improve the Site and our services. We may remove User Content that breaches these Terms.
6) Prohibited Conduct (Acceptable Use)
You agree not to upload, transmit, or share on the Site any content that is unlawful, defamatory, abusive, obscene, fraudulent, invasive of privacy, or infringes third-party rights; or any malware or code that could damage systems. You also agree not to harvest data or attempt unauthorised access.
7) Third-Party Links & Tools
The Site may link to third-party websites (e.g., map locations, video hosting, document drives). We are not responsible for third-party content, policies, or availability. Your use of third-party sites is at your own risk and subject to their terms.
8) Pricing, Availability & Accuracy
Materials are provided for general information only. Prices, availability, specifications, visuals, layouts, and timelines are subject to change without notice and may differ from final as-built conditions or contract documents. Nothing on the Site constitutes a binding offer or legal advice.
9) Privacy & Data Protection
Your use of the Site is also governed by our Privacy Policy (how we collect, use, and protect personal data). Please review it before submitting any information.
10) Disclaimers
The Site and Materials are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties (express or implied), including fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free from harmful code.
11) Limitation of Liability
To the maximum extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages; or for lost profits, data, or business arising from your use of the Site. Our aggregate liability for direct damages will not exceed THB 5,000 (or the minimum amount permitted by Thai law if higher).
12) Indemnity
You agree to indemnify and hold the Company and its directors, officers, employees, and agents harmless from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site.
13) Changes to the Terms
We may update these Terms from time to time. The new version will be posted on this page with the “Effective date.” Your continued use of the Site after changes are posted constitutes acceptance.
14) Governing Law & Dispute Resolution (Thailand)
These Terms are governed by the laws of the Kingdom of Thailand. The parties shall first attempt to resolve disputes amicably in good faith within 30 days of written notice. If unresolved, disputes shall be submitted to the Thailand Arbitration Center (THAC) in Bangkok under the THAC Rules by a single arbitrator. The language of arbitration shall be English. The arbitral award shall be final and binding. The Company may seek interim injunctive relief in the competent courts of Thailand (including Phuket Provincial Court) to protect its rights, including confidentiality and IP.
